Estate Planning for
Divorced Individuals
in Singapore
Divorce changes everything about who should receive your estate — but almost nothing is updated automatically. A former spouse may still be named across multiple documents without you realising.
Why Divorced Individuals Face Distinct Estate Planning Challenges
CPF nomination is not automatically revoked by divorce — the ex-spouse may still be named
The will names the ex-spouse as beneficiary or executor and needs to be rewritten
Insurance policies may still name the ex-spouse as beneficiary
HDB flat ownership and CPF repayment arrangements may have changed through ancillary proceedings but not yet been updated in the estate plan
Children's guardianship arrangements need to be reflected in a new will
Divorce is one of the most comprehensive triggers for an estate planning review — but most of the estate planning updates are not automatic. The legal system does not clear your documents for you.
Without a proactive review, a former spouse may remain named in your CPF nomination, your will, your insurance policies, and potentially your LPA.
For clients with estate planning requirements under Syariah law, separate guidance from a qualified Syariah practitioner is recommended.
Planning Modules
CPF nomination — most urgent Divorce does not revoke a CPF nomination. This must be updated manually via my.cpf.gov.sg. It takes 10 minutes. The consequences of not doing it: your ex-spouse receives 100% of your CPF savings. Do this first.
Insurance beneficiaries — equally urgent Check every insurance policy you hold. Nominees on insurance policies do not change automatically at divorce. Update each policy’s beneficiary nomination through your insurer.
New will Under Singapore’s Wills Act, divorce partially revokes provisions for an ex-spouse — but the rest of the will remains. Partly revoked wills create ambiguity and may not reflect your current intentions. A new will is cleaner.
The new will should address:
- Updated beneficiaries (children, parents, or whoever is now appropriate)
- New executor (not the ex-spouse)
- Guardianship for minor children
- Updated trust provisions if applicable
LPA review If your LPA named your ex-spouse as donee, that needs to be replaced with someone you currently trust.
HDB flat If the divorce ancillary proceedings resulted in a change to HDB flat ownership, ensure that the HDB administrative transfer has been completed. Then review whether the resulting ownership structure (sole name, joint tenancy with a new co-owner) aligns with your estate plan going forward.
Coordinating the full update The risk of doing these updates piecemeal is that mismatches develop. A CPF nomination updated but insurance not updated, or a new will made that references an old HDB ownership structure, leaves gaps. A single coordinated review — covering all four instruments — is cleaner and faster than addressing each independently over months.
Common Gaps
- CPF nomination never updated after divorce (most common)
- Insurance beneficiaries not reviewed
- Partial reliance on the automatic will revocation provisions instead of a full new will
- LPA still naming the ex-spouse
- HDB transfer completed administratively but estate documents not updated to reflect the new ownership structure
Singapore-Specific Rules for Divorced Individuals
Divorce does not automatically revoke a CPF nomination. If you nominated your ex-spouse before the divorce, that nomination is still legally valid and your ex-spouse will receive your CPF savings unless you actively change it. Log in to my.cpf.gov.sg to check and update. Similarly, if the divorce ancillary proceedings changed HDB flat ownership or tenure type, those changes need to be reflected in your estate planning documents. A new HDB tenancy structure after divorce (e.g., one spouse becomes sole owner) changes how the flat passes at death.
Update Your Estate Plan After Divorce
Divorce changes who should receive your estate. Most of those changes are not automatic. A private review identifies exactly what needs to be updated and in what order.
